This matter coming on for public hearing on 11-08-2005 in the presence of
the representatives of the licensees, individuals, consumer rights activists
and other stakeholders at Hyderabad and having stood over for consideration
till this day, the Commission passed the following:

1. Introduction:
1.1 Sections 39(2)(d)(ii) and 40(c) of Electricity Act, 2003 (hereinafter referred to as ‘the Act’) provide for payment of a surcharge (hereinafter also referred to as ‘the cross-subsidy surcharge’ to distinguish it from the ‘additional surcharge’ referred to in section 42(4) of the Act) when a transmission system is used for open access for supply of electricity to a consumer.
